1. Services Provided
The Provider agrees to supply the Client with website hosting and maintenance services according to the monthly plan selected by the Client (Basic, Standard, or Premium).
Domain Registration
Domain registration and annual renewal.
Hosting & SSL
Fast cloud hosting and SSL certificate management.
Uptime Monitoring
24/7 uptime monitoring to keep your site online.
Daily Backups
Daily automated backups to safeguard your data.
Security Updates
Security patches and plugin/CMS updates applied regularly.
Content Updates
Monthly content updates (e.g., minor text or image changes) depending on chosen tier.
Analytics & SEO
Analytics and SEO reporting depending on chosen tier.
Major structural changes, new page creation, or redesigns are not covered under standard monthly maintenance and will be quoted separately.
2. Billing and Payment
Subscription Fee
The Client agrees to pay the recurring monthly fee associated with their chosen plan ($29, $59, or $99/mo).
Auto-Renewal
Payments will be automatically processed each month via Stripe using the payment method on file.
Late Payments
If a payment fails, the Provider will attempt to process it again over a 7-day grace period. If payment is not received within 14 days of the due date, the Provider reserves the right to suspend hosting services, resulting in the website going offline until the balance is paid.
3. Uptime Guarantee
The Provider strives to maintain a 99.9% network uptime. However, the Provider is not responsible for website downtime caused by circumstances beyond its reasonable control, including but not limited to acts of God, major internet backbone outages, or malicious third-party attacks (e.g., DDoS attacks). In the event of extended downtime directly caused by the Provider's server infrastructure, the Client's sole remedy shall be a prorated credit toward their next month's hosting fee.
4. Cancellation and Offboarding
Cancellation
The Client may cancel their monthly subscription at any time without penalty via the Stripe billing portal or by emailing the Provider.
Service Continuation
Upon cancellation, the website will remain live until the end of the current paid billing cycle. No prorated refunds will be issued for partial months.
Offboarding Process
Because the Client owns their website 100%, upon cancellation, the Provider will supply a full export of the website files and database upon request. The Provider is not responsible for migrating the website to a new host or configuring the new hosting environment. Once the billing cycle ends, the Provider will delete the website from its servers.
Domain Transfer
If the Provider registered the domain on the Client's behalf, the Provider will transfer ownership of the domain to the Client upon cancellation, provided the Client assumes all future renewal costs.
5. Security and Backups
While the Provider performs daily automated backups and implements security patches, the Client acknowledges that no website is entirely immune to hacking or data loss. The Provider is not liable for any damages resulting from data breaches, lost data, or unauthorized access, provided the Provider has maintained standard industry security practices.
6. Limitation of Liability
The Provider shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, or use, incurred by the Client or any third party, whether in an action in contract or tort, arising from the Client's access to, or use of, the hosting services.
7. Modifications to Terms
The Provider reserves the right to update the pricing or terms of this Agreement with 30 days' written notice to the Client. If the Client does not agree to the new terms, they may cancel their service before the changes take effect.
