By accessing SitesDiscovery's website or purchasing any of our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you ("Client") and SitesDiscovery ("we," "us," or "our").
2. Services Provided
SitesDiscovery provides AI-assisted website design and generation services for small and local businesses. Our service includes designing, building, and delivering a completed website based on the information you provide. The scope of pages, features, and revisions included depends on the plan you select at the time of purchase.
3. Order & Payment
Payment
Full payment is required before work begins. We do not offer payment plans unless explicitly agreed upon in writing.
Accepted Methods
We accept all major credit/debit cards and any other payment methods explicitly offered at checkout.
Currency
All prices are listed and charged in US Dollars (USD).
Taxes
You are responsible for any applicable taxes in your jurisdiction. Our listed prices do not include VAT or local taxes where applicable.
4. Delivery
Turnaround Time
We aim to deliver your initial website draft as quickly as possible, typically within 24–72 hours of receiving your completed intake form and payment confirmation.
Delays
Delivery timelines may be affected by incomplete or unclear information provided by the client. SitesDiscovery is not responsible for delays resulting from client unresponsiveness.
Format
Deliverables will be provided as a published/hosted website, exported files, or both, as specified in your selected plan.
5. Revisions
Included Revisions
The number of revisions included depends on your plan: Starter (1 revision), Growth (3 revisions), Pro (unlimited within scope). Each revision request must be submitted in a single, consolidated list of changes.
Scope of Revisions
Revisions are defined as modifications to the existing design and content — not the addition of entirely new sections, pages, or functionality beyond the original scope.
Additional Revisions
If you require revisions beyond your plan's included amount, additional revisions can be purchased at an agreed-upon rate.
6. Client Responsibilities
Accurate Information
You are responsible for providing accurate, complete, and lawful business information, logos, images, and any other content you supply.
Content Ownership
By providing content (text, images, logos), you confirm you own or have the legal right to use that content, and you grant SitesDiscovery permission to use it to build your website.
Review Promptness
You agree to review delivered work within 7 business days and submit any revision requests in writing. Failure to respond within this window will be considered acceptance of the delivery.
7. Refund Policy
Pre-Work Refund
If you request a refund before work has commenced (i.e., before your intake form has been processed), you are eligible for a full refund.
Post-Delivery
Once your website draft has been delivered, refunds are not available. We are committed to working with you through the revision process to ensure satisfaction.
Dispute Resolution
If you are unsatisfied with the deliverable, please contact us at Josiahplacide.work@gmail.com before initiating any dispute or chargeback. We are committed to resolving issues fairly and promptly.
8. Intellectual Property
Ownership Transfer
Upon receipt of full payment and final delivery acceptance, you own the delivered website design and content. Full rights to the design, code, and copy are transferred to you.
Portfolio Rights
Unless you explicitly request otherwise in writing, SitesDiscovery reserves the right to showcase your completed website in our portfolio, case studies, and marketing materials.
Our Tools & Systems
SitesDiscovery retains all intellectual property rights to our internal AI systems, templates, design frameworks, and proprietary workflows used to generate your website. These are not transferred to the client.
9. Limitation of Liability
To the maximum extent permitted by applicable law, SitesDiscovery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising from your use of our services. Our total liability for any claim related to our services shall not exceed the amount you paid for the service in question.
10. Disclaimer of Warranties
Our services are provided "as is" and "as available." We make no warranties, expressed or implied, regarding the merchantability, fitness for a particular purpose, or accuracy of generated content. We do not guarantee specific business results (e.g., traffic, leads, or revenue) from the use of the delivered website.
11. Prohibited Uses
You agree not to use our services to create websites that promote illegal activities, hate speech, harassment, adult content, fraudulent schemes, or any content that violates applicable laws. SitesDiscovery reserves the right to refuse service to any client whose requested content violates these standards.
12. Modifications to Terms
SitesDiscovery reserves the right to update these Terms of Service at any time. We will notify clients of material changes by posting an updated version with a new effective date. Continued use of our services after changes constitutes acceptance of the revised terms.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable laws. Any disputes arising from or related to these terms shall first be pursued through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration.
