1. Description of Services
SitesDiscovery provides AI-powered, custom-built websites for small businesses, along with ongoing hosting and maintenance plans. Our services include a one-time website build phase (Starter, Growth, or Pro plans) and an ongoing monthly subscription for hosting and maintenance (Basic, Standard, or Premium plans).
2. User Accounts and Billing
Account Security
You are responsible for maintaining the confidentiality of any account credentials provided to you (such as access to the Stripe billing portal) and for all activities that occur under your account.
Payments
All payments are processed securely through Stripe. By providing a payment method, you authorize us to charge the applicable fees (one-time build fees and recurring monthly hosting fees) to your designated payment method.
Cancellations
You may cancel your monthly hosting subscription at any time via the billing portal. Upon cancellation, your website will remain live until the end of your current billing cycle. No refunds are provided for partial months.
3. "Live in 7 Days" Guarantee
We advertise that your website will be "live in 7 days or your money back." This guarantee is contingent upon your timely cooperation. You must provide all necessary business details, branding, and feedback within the timeframes requested by our team. Delays on your part will void this guarantee.
4. Intellectual Property
Your Ownership
Upon full payment of the one-time website build fee, you own 100% of the website design, content, and code created for you. If you cancel your hosting, you are entitled to a full export of your site files.
Our Intellectual Property
The SitesDiscovery platform, its underlying AI technology, our branding, and our website content are the exclusive property of SitesDiscovery and are protected by copyright and trademark laws.
Client Content
You represent and warrant that you own or have the necessary licenses to use any text, images, or other materials you provide to us for inclusion on your website.
5. Prohibited Conduct
Illegal Content
You agree not to host or publish illegal, defamatory, obscene, or highly offensive content.
Malware
You agree not to distribute malware, viruses, or other malicious code through your website.
Spam
You agree not to engage in spamming or unauthorized promotional activities.
IP Infringement
You agree not to infringe upon the intellectual property rights of others.
We reserve the right to suspend or terminate your hosting services immediately, without refund, if we determine that your website violates these Terms.
6. Disclaimer of Warranties
Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for 99.9% uptime and high-quality design, SitesDiscovery makes no warranties, express or implied, regarding the specific results, search engine rankings, or business revenue you will achieve by using our Services.
7. Limitation of Liability
To the maximum extent permitted by law, SitesDiscovery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; or (b) any unauthorized access to or use of our servers and/or any personal information stored therein.
8. Indemnification
You agree to indemnify, defend, and hold harmless SitesDiscovery and its founder, employees, and contractors from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, the content you provide for your website.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
