1. Scope of Work
The Agency agrees to provide website design and development services according to the plan selected by the Client at checkout (Starter, Growth, or Pro). The specific deliverables, including the number of pages, design quality, and included features (such as AI-generated content and lead capture forms), are defined by the selected plan on the SitesDiscovery website at the time of purchase.
Any additional features, pages, or services requested outside the scope of the selected plan will be considered "Out of Scope" and will require a separate agreement and additional fees.
2. Revisions and Feedback
The Client is entitled to a specific number of revision rounds based on their selected plan:
Starter Plan
1 Revision Round.
Growth Plan
3 Revision Rounds.
Pro Plan
Unlimited Revisions (within the original scope).
A "Revision Round" is defined as a single, consolidated list of requested changes submitted by the Client after reviewing the initial website draft. Once the allotted revision rounds are exhausted, any further design or structural changes will be billed at the Agency's standard hourly rate.
3. Client Responsibilities
To meet the Agency's "Live in 7 Days" delivery timeline, the Client agrees to provide all necessary inputs — including business details, branding assets (logos, colors), and specific service information — within 48 hours of onboarding.
Failure to provide this information promptly will result in a delay of the delivery timeline, and the 7-day guarantee will be voided.
4. Payment Terms
Website Build Fee
The Client agrees to pay the one-time build fee associated with their chosen plan ($499, $999, or $1,499) upfront before any work commences.
Refund Policy
The Agency offers a "live in 7 days or your money back" guarantee, provided the Client has met all their responsibilities outlined in Section 3. Once the website is approved and launched, the build fee is non-refundable.
5. Intellectual Property and Ownership
Upon final approval and full payment of the build fee, the Client will own 100% of the website design, content, and code. The Agency retains the right to display the completed website in its portfolio and marketing materials unless the Client explicitly requests an NDA or confidentiality agreement.
The Client guarantees that any text, graphics, photos, or other artwork they provide to the Agency are owned by the Client or that the Client has permission to use them. The Client agrees to indemnify and hold the Agency harmless from any claims or legal actions related to copyright infringement for materials provided by the Client.
6. Warranties and Liability
The Agency will build the website in accordance with modern web standards and ensure it is mobile-responsive and SEO-ready at launch. However, the Agency does not guarantee specific search engine rankings, sales, or website traffic.
The Agency's liability for any claim arising out of this Agreement shall not exceed the total amount paid by the Client for the website build. The Agency is not liable for any indirect, incidental, or consequential damages, including lost profits.
7. Termination
Either party may terminate this Agreement before the website is launched by providing written notice. If the Client terminates the project after work has begun but before completion, the Agency retains the right to keep a prorated portion of the upfront fee based on the work completed.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York.
